DECATHLON MEMBERSHIP PROGRAM

1.      Introduction

1.1.    Please read these terms and conditions together with our privacy policy (available on www.decathlon.co.za) very carefully. The Decathlon Membership Program is operated by Decathlon South Africa Sports (Pty) Ltd (registration number 2015/118486/07) (“Decathlon”; “we”; “our”; “us”). Our registered address is Cnr Wedgewood Link Road and William Nicol Drive, Bryanston, Sandton, 2191 and we will accept service of all legal documents here. 1.2.    By creating an account on the Decathlon website: www.decathlon.co.za (the “website”) or otherwise signing up to join the Decathlon Membership Program and using the related services, you agree to the current terms and conditions set out on this page and Decathlon’s privacy policy. Decathlon’s privacy policy is hereby incorporated  by reference into these Decathlon Membership Program terms.

1.3.     Decathlon reserves the right, without notice and at its sole and absolute discretion,  to change and update these membership terms and conditions from time to time and recommend that you revisit this page regularly to keep informed of the current terms and conditions that apply to your membership. Such changes will take effect when they are published. These terms and conditions contain specific provisions to limit Decathlon’s liability, allocated risk or liability to you or act as an acknowledgement of certain facts by you.

1.4.     If you do not accept these terms and conditions you will not be able to participate in or benefit from the Decathlon Membership Program. If you continue to participate in the Decathlon Membership Program or use the related services, you will be deemed to have accepted the amended terms and conditions.

1.5.     You will automatically become a member of the Decathlon Membership Program when you sign up and create an account on the website or when you register in-store.

1.6.    You agree to our terms of use and to receive information from us relating to our products and services. You will share certain personal information and give consent to us processing your personal information in order to provide services to you, in accordance with the terms set out herein and in our privacy policy.

2.      How does the Decathlon Membership Program work?

2.1.    How do you sign up?

2.1.1.  When you sign up on the website you will automatically become a member of the Decathlon Membership Program.

2.1.2.  You will also be able to join by scanning the QR code you can find in any of the Decathlon stores or by asking for assistance from a teammate in store to register you at the till point.

2.1.3.  To join the Decathlon Membership Program you must be (a) 18 years or older; (b) be in possession of a  valid South Africa ID; passport; or other proof of legal residency in South Africa; (c) provide us with your latest email address and cell phone number.

2.2.    What are the benefits of signing up?

2.2.1.  All of your purchases from Decathlon will be stored in one place that you can refer to.

2.2.2.  You will be able to make refunds 365 days of the year without the physical till receipt, subject to our returns policy.

2.2.3.  You will have product traceability for warranty support.

2.2.4.  If you provide consent, you may receive personalized communications about products, services and events that you may be interested in.

2.2.5.  You can receive tips and advice from experts.

2.2.6.  You will be able to share your reviews of Decathlon’s products and services.

2.2.7.  Decathlon may add additional benefits and services from time to time. Please review these terms from time to time to ensure that you are getting the most out of the Decathlon Membership Program.

2.3.    Decathlon reserves the right to exclude certain goods and/or services from the Decathlon Membership Program.

3.      Collecting Your Information

3.1.    We need your consent for the use and processing of your information in order for you to have access to ALL the Decathlon Membership Program benefits

3.2.    You confirm that you have read, understood and accepted the information processing terms set out in these terms. You therefore agree that your personal information may be processed according to these terms and conditions.

3.3.    You will at all times be in a position to request, where necessary, the correction, destruction or deletion of your personal information. Decathlon will process your request as soon as reasonably possible. For more information on this, please see our privacy policy.

3.4.    The deletion or destruction of your personal information may, depending on the type information you request us to delete, result in the (i) termination of your participation in the Decathlon Membership Program or (ii) limitation on the access to all of the service we offer as we may not be able to offer you the full complement of our services without certain information.

3.5.    By accepting the terms and conditions as set out herein, you confirm that you are aware of the information that is being collected by us and the purpose for which the information is collected.

3.6.    Decathlon may collect information about you as follows 

3.6.1.  From you when you make use of any of its direct marketing channels and services relating to the Decathlon Membership Program, for example, when you sign up as a member, fill in an application or other form, submit a request, conduct a transaction in a Decathlon store or website, or enter promotional competitions relating to the Decathlon Membership Program;

3.6.2.  From people and entities that Decathlon uses to provide services to it. This may include  communication and data hosting services, processing and management services;

3.6.3.  From any other persons you have permitted to provide information to Decathlon; and

3.6.4.  From platforms using anonymised data from outside Decathlon which have been designed to give us a better understanding of you and your needs and preferences in an anonymous manner without sharing any of your personal information. This will only be used to create a better personalised offering for you and not for any purpose not in line with these terms and conditions.

3.7.    Certain communications may be sent to you via direct marketing channels including email, sms or whatsapp. Please make sure that we always have your correct contact details to ensure that you receive your offers and communications. We cannot accept responsibility if you do not receive certain offers and communications because you provided us with incorrect contact details.

4.       Direct Marketing

4.1.    If you have agreed that we may contact you for marketing purposes, we may send you promotional offers for products, services and/or events which may be of interest to you.

4.2.    If you have opted-in to receive direct marketing communications, you may opt out, either when you first subscribe to become a member of the Decathlon Membership Program or at any time thereafter. When Decathlon send you communications you can opt-out by exercising the opt out function on the channel used to communicate with you, alternatively you may contact out customer relations team on [email protected]. Your information will be removed from Decathlon’s contact list within 14 days of your request to opt-out.

5.      Information processing

5.1.    Decathlon South Africa Sports (Pty) Ltd is a subsidiary of Decathlon S.E. (“Decathlon Group''). When you share your information with us,  you agree to also share it with the Decathlon Group. In some instances you may also be sharing your information with other companies that help us provide services to you, for example, the company that delivers your online shopping.

5.2.    We use your personal information to create a personalised profile for you to ensure you get the most out of being a member. We keep your personal information private, and only disclose it to other companies if you ask us to, or if they need it to help us provide services to you. 5.3.    Decathlon will not use or disclose your personal information without your permission, unless it has a legal duty to do so or is required to do so in the course of the provision of the Decathlon Membership Program.

5.4.    By signing up for the Decathlon Membership Program you consent that Decathlon may record, use and hold the following types of information about you:

5.4.1.  All information provided when you sign up to be a member and contained in  the forms or other documentation you submit to Decathlon and any other subsequent information or details you update or provide afterwards. This may include your name, contact details, age and identity/passport number, transaction records;

5.4.2.  Details of your preferences concerning Decathlon’s products and services when participating in the Decathlon Membership Program across all of Decathlon’s stores and platforms;

5.4.3.  Other demographic and lifestyle information which is derived from your shopping patterns when you are a member of the Decathlon Membership Program; and

5.4.3.  Details of when you contact Decathlon and when Decathlon contacts you. This includes, for example, electronic mail addresses, telephone numbers you contact Decathlon from and the content of the communications with Decathlon (which may be recorded).

5.5.    Your information is needed for the following purposes:

5.5.1.  To process your application to become a member of the Decathlon Membership Program. This may include confirming your identity and contact details;

5.5.2.  To keep a record of all of your transactions with Decathlon as well as provide you with a digital receipt of your purchases;

5.5.3.  To enable you to make returns without your physical  receipt;

5.5.4.  To take such actions as may be required to enable and improve your use of Decathlon’s services;

5.5.5.  To make sure that the information Decathlon receives and records about you is and remains accurate, complete and up to date;

5.5.7.  To conduct market research and data analysis, understand your preferences, learn more about the products and services that you are interested in and improve the products and services Decathlon offers you;

5.5.8.  To inform and provide you with the chance to use products, services and benefits Decathlon offers and believes may be of interest to you (to the extent that Decathlon is legally permitted to do so); and

5.5.9.  For such other purposes as you may agree to or as may otherwise be legally permitted whether to protect Decathlon’s or your interests or those of Decathlon’s suppliers and other customers.

6.       Protecting your information

6.1.    Decathlon will, at all times, take reasonable steps to ensure that your information is protected against unauthorised or accidental access, processing or loss and will implement reasonable technical and organisational controls to do so.

6.2.    We use your personal information to create a profile for you. We keep your personal information private, and only disclose it to other companies if you ask us to, or if they need it to help us provide a service to you.

6.3.    Where Decathlon uses any other person or organisation to host, manage or process your data on its behalf, it will require them to implement the same or similar controls to protect your information.

6.4.    As soon as reasonably possible (provided that Decathlon is not prevented from doing so by any law enforcement or regulatory agency), Decathlon will notify you by email or text message if it believes that an unauthorised access to your information may have occurred. In such instances Decathlon will provide you with such information as you may reasonably require to protect your interests.

7.      Sharing your information

7.1.    You agree that Decathlon may transfer or make your information available to the following persons and organisations (whether they are located in or outside South Africa) in order to achieve the data processing purposes set out herein and to ensure the optimal functioning of Decathlon Membership Program:

7.1.1.  To the divisions and entities in the Decathlon Group. This includes its directors, employees, contractors, agents, auditors, legal and other professional advisors of the divisions and entities, the latter stakeholders will have permission based access only, to the extent that it is necessary for them to view your information; 

7.1.2.  To any other person that supplies, supports or underwrites any products or services Decathlon provides to you, but only to the extent to which it relates to your subscription to and use of Decathlon’s products and services;

7.1.3.  To persons who provide services to Decathlon in relation to the products and services you obtain from it. This may include services such as delivery, data hosting and processing and management services;

7.1.4.  To any person to whom Decathlon cedes, delegates, transfers or assigns any of its rights or obligations relating to the Decathlon Membership Program;

7.1.5.  To any person that acts as your legal guardian, curator or who acts in a similar capacity.

7.2.    Please note that at all times, Decathlon will ensure that the persons to whom your information is transferred or made available, undertake to protect the confidentiality of your information in a manner similar to that set out herein.

7.3.    We do not sell information to third parties for marketing purposes and take comprehensive measures to keep your information safe.

8.       Retention of personal information

8.1.    Decathlon may retain your information collected for as long as you are registered as a member of the Decathlon Membership Program or to engage you as a Decathlon customer for up to 3 years after you have requested us to delete your profile, or longer, if required to do so by law.

9.      Your rights regarding your information

9.1.    You have a right to know what information Decathlon retains about you and to whom it has disclosed such information, for more information on this please contact us on [email protected].

9.2.    You also have the right to ask Decathlon to correct or delete any information it holds about you. This may be because the information is inaccurate, irrelevant, excessive, out of date, incomplete, misleading. It remains your responsibility to inform Decathlon of any changes to your personal information.

9.3.    Please note that Decathlon is only able to fulfil your request where permitted to do so by law and provided that doing so does not unreasonably prejudice its legitimate interests or those of any third party.

9.4.    You are entitled, in terms of the Protection of Personal Information Act 4 of 2013, to submit a complaint to the Information Regulator in the prescribed manner and form if you suspect interference with your personal information by us. 10.    Liability

10.1. You hereby indemnify the Decathlon Group, Decathlon, its employees and/or agents of any liability for any failure to perform or delay in performance caused by events outside of the reasonable control of Decathlon (for example strikes, trade disputes, accident, computer failure, breakdowns, power failures, shortages affecting Decathlon’s usual sources of supply or Decathlon’s means of delivery of the products or services), save to the extent that such liability cannot be excluded by applicable law.

10.2.  Neither Decathlon, its agents, associated companies, nor any directors, officers or employees of such, shall be liable for any loss or damage, whether direct, indirect, consequential or otherwise arising from any cause whatsoever, which you or a third party may suffer regarding your participation in the Decathlon Membership Program.

10.3.  Decathlon shall not be responsible for any lost, damaged, delayed, incorrect or incomplete applications for any reason whatsoever.

10.4.  Decathlon shall not be responsible for the failure of any technical element relating to the Decathlon Membership Program which may result in a benefit not being successfully redeemed.

10.5.  In the event that Decathlon is found to be liable in respect of any claim(s) in connection with the Decathlon Membership Program or any related benefit, its liability will not exceed the monetary value of the benefit in question, regardless of the reason for its liability, whether it stems from contract, statute or delict, save to the extent that such liability cannot be excluded by applicable law.

11.   General

11.1. Decathlon shall have the right to change or terminate the Decathlon Membership Program and omit certain goods or services from it, immediately and without notice, if deemed necessary in its opinion or if circumstances arise outside of its control. In the event of such change or termination, you agree to waive any rights that you may have in respect of the Decathlon Membership Program and acknowledge that you will have no recourse against Decathlon or its agents.

11.2.  Any abuse whatsoever of the Decathlon Membership Program by any person constitutes a criminal offence and Decathlon reserves the right to cancel such person’s membership and withhold all Decathlon benefits from his/her account.

11.3.  These terms and conditions will be subject to and interpreted under the laws of the Republic of South Africa and the South African courts will have exclusive jurisdiction over any claim arising in connection herewith.

11.4.  Decathlon reserves the right to disqualify any claim if fraud is suspected, including without limitation, through the manipulation of code or otherwise frequently falsifying data.

11.5.  You must provide Decathlon with true and accurate information. If you have given incorrect information, Decathlon reserves the right to decline your application or cancel your membership.

11.6.  You may not assign or otherwise transfer all or any part of your rights or obligations under these terms and conditions. You agree that Decathlon may, in its sole and absolute discretion, transfer and assign all or part of its rights and obligations under these terms and conditions to one or more third parties chosen by it.

11.7.  If any clause or sentence in these terms and conditions is held by a court of law to be void, illegal or unenforceable, the remaining provisions hereof will not be affected and will remain of full force and effect.

9.3.    Please note that Decathlon is only able to fulfil your request where permitted to do so by law and provided that doing so does not unreasonably prejudice its legitimate interests or those of any third party.

9.4.    You are entitled, in terms of the Protection of Personal Information Act 4 of 2013, to submit a complaint to the Information Regulator in the prescribed manner and form if you suspect interference with your personal information by us. 10.    Liability

10.1. You hereby indemnify the Decathlon Group, Decathlon, its employees and/or agents of any liability for any failure to perform or delay in performance caused by events outside of the reasonable control of Decathlon (for example strikes, trade disputes, accident, computer failure, breakdowns, power failures, shortages affecting Decathlon’s usual sources of supply or Decathlon’s means of delivery of the products or services), save to the extent that such liability cannot be excluded by applicable law.

10.2.  Neither Decathlon, its agents, associated companies, nor any directors, officers or employees of such, shall be liable for any loss or damage, whether direct, indirect, consequential or otherwise arising from any cause whatsoever, which you or a third party may suffer regarding your participation in the Decathlon Membership Program.

10.3.  Decathlon shall not be responsible for any lost, damaged, delayed, incorrect or incomplete applications for any reason whatsoever.

10.4.  Decathlon shall not be responsible for the failure of any technical element relating to the Decathlon Membership Program which may result in a benefit not being successfully redeemed.

10.5.  In the event that Decathlon is found to be liable in respect of any claim(s) in connection with the Decathlon Membership Program or any related benefit, its liability will not exceed the monetary value of the benefit in question, regardless of the reason for its liability, whether it stems from contract, statute or delict, save to the extent that such liability cannot be excluded by applicable law.

11.   General

11.1. Decathlon shall have the right to change or terminate the Decathlon Membership Program and omit certain goods or services from it, immediately and without notice, if deemed necessary in its opinion or if circumstances arise outside of its control. In the event of such change or termination, you agree to waive any rights that you may have in respect of the Decathlon Membership Program and acknowledge that you will have no recourse against Decathlon or its agents.

11.2.  Any abuse whatsoever of the Decathlon Membership Program by any person constitutes a criminal offence and Decathlon reserves the right to cancel such person’s membership and withhold all Decathlon benefits from his/her account.

11.3.  These terms and conditions will be subject to and interpreted under the laws of the Republic of South Africa and the South African courts will have exclusive jurisdiction over any claim arising in connection herewith.

11.4.  Decathlon reserves the right to disqualify any claim if fraud is suspected, including without limitation, through the manipulation of code or otherwise frequently falsifying data.

11.5.  You must provide Decathlon with true and accurate information. If you have given incorrect information, Decathlon reserves the right to decline your application or cancel your membership.

11.6.  You may not assign or otherwise transfer all or any part of your rights or obligations under these terms and conditions. You agree that Decathlon may, in its sole and absolute discretion, transfer and assign all or part of its rights and obligations under these terms and conditions to one or more third parties chosen by it.

11.7.  If any clause or sentence in these terms and conditions is held by a court of law to be void, illegal or unenforceable, the remaining provisions hereof will not be affected and will remain of full force and effect.
